These Terms and Conditions («Terms») govern access to and use of Tortoise, a B2B lead generation service operated by Libélula CRM («the Owner»). By signing up or using the service, the user accepts these Terms, the Legal Notice and the Privacy Policy.
To use Tortoise you need to create an account with a valid email address. The user is responsible for keeping their credentials confidential and for all activity carried out from their account. They must be of legal age and use the service as part of a professional or business activity.
The service works with credits. Each search and each enriched lead use credits as shown in the dashboard. A free initial balance is offered, together with the option to buy credit packs. Payments are processed through Stripe; the Owner does not store card details. Purchased credits do not expire unless stated otherwise. As this is a digital service consumed immediately, once used, credits are non-refundable, without prejudice to the rights granted by consumer law where applicable.
The user undertakes to use Tortoise in accordance with the law and these Terms. In particular, it is forbidden to:
The user is solely responsible for the commercial communications they make based on the data obtained and for complying with the applicable law (GDPR, LSSI-CE and data protection and e-commerce law).
Tortoise finds and displays company contact information published in publicly accessible sources. The Owner does not guarantee the accuracy, validity or availability of that data, which is provided «as is». The user must check that the data is suitable for their purpose.
The AI analysis features require the user to set up their own key from an AI provider. The cost and use of that provider are borne by the user, under the terms of the chosen provider. AI-generated results are indicative and may contain errors; the user must check them before making decisions.
API access is via personal keys subject to request and credit limits. Misuse of the API may lead to access being limited or suspended.
The Owner strives to keep the service available and secure, but does not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, the Owner will not be liable for indirect damage, loss of profit or data loss arising from the use of or inability to use the service.
The Owner may suspend or cancel accounts that breach these Terms. The user may stop using the service and request the deletion of their account at any time by writing to the contact address.
The Owner may change these Terms and the service. Changes will be published on this page with their update date. Continued use of the service implies acceptance of the version in force.
These Terms are governed by Spanish law. Disputes will be submitted to the competent courts and tribunals under the law.
